The purchase of your travel booking constitutes a contractual agreement between the traveler(s), customer(s), and/or purchaser(s), (collectively as “You” and “Traveler”), and Zotto Travel LLC (“We,” “Us,” "Agency," "Travel Agency") pursuant to the following terms and conditions (“Terms,” “Agreement”). The lead passenger assumes the responsibility of sharing these terms and conditions with each passenger in their group, including payment of all amounts when due. It is the responsibility of each passenger to read our terms and conditions in its entirety. In addition, we reserve the right to modify these Terms and Conditions. If there is any part of these terms and conditions that you do not agree with, please do not use our travel services.
TRAVEL AGENT: Zotto Travel LLC acts as a travel agent only. We sell various travel related products on behalf of numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators, tours and hotels. Zotto Travel LLC does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. Zotto Travel LLC's obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not Zotto Travel LLC. Conditions can change rapidly in a country at any time. It is your responsibility to check the USA Government Travel advisories for your intended destination at https://travel.state.gov/content/travel.html.
IMPORTANT CONDITIONS: Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. You expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase.
CANCELLATION: Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.
DEPOSIT AND FINAL PAYMENT: You will be required to pay a minimum deposit when booking. The service provider may require further deposits. All deposits are non-refundable. Final payment is required no less than 60 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking. While Zotto Travel LLC does accept major credit cards including Visa, Mastercard, American Express and Discover, customers must provide a signed charge authorization agreement for your trip.
CREDIT CARD TRANSACTIONS: Your authorization is a binding agreement for us to charge your credit card, and as such, you waive any right to a chargeback for any cause, including a force majeure event, as defined herein, and agree to refund policies and procedures as outlined in these terms and conditions. If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Zotto Travel LLC and in the event that payment has been made to Zotto Travel LLC by credit card, you agree that you will not seek to chargeback your payment to Zotto Travel LLC. If the credit card is passed through to the travel services provider and you seek to chargeback your payment from the provider, you agree to be held liable and indemnify Zotto Travel LLC against this chargeback from the provider, including without limitation any air debit memos charged to Zotto Travel LLC. If Zotto Travel LLC incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back, reversed or recollected by you or your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owed to Zotto Travel LLC immediately. “Force majeure” means, in relation to our agency, in any circumstances beyond our reasonable control, (including, but without limitation, to acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, sickness, epidemics, pandemics, quarantines, government intervention, weather conditions, defects in machinery and vehicles, delays or other unforeseeable event), we shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, and shall not provide any refund, by reason of delay in performance, or by non-performance, of any of our obligations hereunder to the extent that any such delay or non-performance is due to any force majeure. If our agency, and/or any of our travel suppliers, are affected by force majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to your trip.
FORCE MAJEURE: There may be times when either party are unable to perform, or complete performance, under the travel contract for reasons out of each other’s control. These are called force majeure events and if occurs, make performing under the contract inadvisable, commercially impracticable, illegal, or impossible. Events that may trigger this provision include, but are not limited to, acts of God, acts of government, acts of war or civil unrest, insurrection or revolts, military action, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, pandemics, epidemics, illnesses or health conditions prevalent in the area of travel, earthquakes, hurricanes, lightning, and explosions, unexpected legislation, or any other event outside the reasonable control of either party.
In the event that a force majeure event occurs, the parties will look to and follow the cancellation policies of the suppliers, what is stated in the travel proposal and these terms & conditions. Any changes to those policies are at the sole discretion of the supplier (if applicable) and Travel Agency. Passenger will be informed of their options if a force majeure event occurs.
TRAVEL PROTECTION: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. There are many benefits available in high value plans including cancellation penalty reimbursement, delay coverage, baggage loss coverage, medical care, emergency evacuation and more. Additionally, most health insurance policies do not provide medical coverage for international travel. In order for you to obtain coverage for certain pre-existing conditions, your insurance policy must be purchased at the time of booking or shortly there after. However, Zotto Travel LLC is not an insurance company and has no responsibility for the submission, payment, denial or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.
ADDITIONAL FEES: Additional taxes and surcharges that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers. Most properties and vehicle rental/leasing companies require a credit card imprint at check-in.
BAGGAGE FEES: Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding their checked baggage policies.
RESPONSIBILITY: We always do our best to make sure your travel arrangements are satisfactory. However, Zotto Travel LLC and its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and independent contractors do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to Zotto Travel LLC or any of Zotto Travel LLC's affiliated entities.
RISKS AND SAFETY: Travel to certain destinations may involve greater risk than others. Zotto Travel LLC urges you to remain informed about current news events, travel prohibitions, warnings, announcements and advisories issued by the United States Government. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/. ZOTTO TRAVEL LLC DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO ANY DESTINATION IS ADVISABLE OR WITHOUT RISK BY OFFERING THE SALE OF TRAVEL AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CUSTOMER’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CUSTOMER’S OWN RISK.
LIABILITY: Zotto Travel LLC is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, Zotto Travel LLC is not responsible for any injury, loss, death, quarantine, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to U.S. standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner's risk. The prices of tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. You specifically agree that Zotto Travel LLC is not liable for any consequential loss or damage. ZOTTO TRAVEL HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM ZOTTO TRAVEL WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY ZOTTO TRAVEL.
COVID-19: You request that Zotto Travel LLC (“Agency”) and its agents make one or more travel bookings on your behalf. As the worldwide COVID-19 coronavirus pandemic remains ongoing at this time, you acknowledge that for this reason, and other reasons not reasonably foreseeable at this time, these travel plans may be interrupted or cancelled by the supplier that is providing them, a government entity or other third party over which Agency has no control. You further acknowledge that the supplier’s own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern your rights and remedies, including your right to receive a refund, in such an event. Moreover, you understand that should you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances. You hereby agree to hold Agency and its agents harmless and release it from any and all liability for any damages, including but not limited to monetary losses, you may incur as a result of such interruption or cancellation of these travel plans.
By purchasing travel through Zotto Travel LLC, you understand that COVID-19 is a highly contagious virus that can be spread via person-to-person contact. Agency will take reasonable efforts to provide the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in the travel itinerary.
As a traveler, you understand that Agency’s supplier(s) may have policies in place to help prevent the spread of COVID-19. Agency is not the drafter or holder of those policies and these policies can change at any time. The supplier(s) may not apply these policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate.
Each state/country institutes their own pandemic-protective policies and regulations. As a traveler, you further understand that you are responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all state(s)/country(ies) listed in the travel itinerary, including any policy updates. Entry into another country may be denied for reasons within or outside of anyone’s control. By traveling, you can be subject to voluntary or involuntary quarantine either at home or in the traveled location(s). You are responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all vendors used in your travel itinerary, including any policy updates.
With full awareness of the risks involved, you, for yourself, and on behalf of your traveling companions, including, but not limited to, your family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release travel agency its officers, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering Agency. You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of Agency services, or the services of Agency’s suppliers or vendors, specifically related to COVID-19.
PASSPORTS AND TRAVEL DOCUMENTATION: All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for 6 months or longer than your intended travel time. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State, or representative government agency of the country to which you are traveling, to confirm the requirements for visas and/or other requirements for admission to your destination. It is your responsibility to ensure you are aware of any health and legal requirements for your travel destinations and to ensure that you carry all necessary documentation. Travelers with passports that are found to be washed, mutilated, or damaged may be refused entry. U.S. citizens should be aware that countries can deny foreigners entry if they have been charged or convicted of a serious crime. If you do not have a passport at time of booking, it is your responsibility to secure one and Zotto Travel LLC is not liable should you not receive it in time, or for any reason. Children under the age of 18 traveling with only one parent or someone who is not a parent or legal guardian should travel with a notarized letter of consent. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A valid government issued ID is required for travel within the USA, however depending on the State of departure or arrival, a passport may be required instead of a driver’s license in addition to health documentation. It is the traveler's responsibility to provide the correct documents and failure to do so may result in being denied entrance or boarding for the flight. Regrettably, we are unable to refund unused flights, hotel, or add-ons because of denied entrance or boarding situations. TRAVEL DOCUMENTS: Travel documents including, without limitation, airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking. Please reconfirm your flights at least 24 hours prior to departure.
HEALTH AND SPECIAL REQUIREMENTS: It is your responsibility to ensure you are aware of any health and legal requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation.
HAZARDOUS MATERIALS: Federal law prohibits passengers from bringing hazardous materials on the aircraft.
(1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.
(2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed http://www.tsa.gov/traveler-information/prohibited-items.
We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: https://www.transportation.gov/airconsumer/spray
REFUSAL OF SERVICE: Service providers reserve the right to refuse service to travelers at their sole discretion and including without limitation if the traveler; (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. Zotto Travel LLC assumes no liability for the acts of the service provider in refusing service.
OUR PROMISE TO YOU: All vacations arranged through Zotto Travel LLC come with peace of mind. We are experienced professionals dedicated to the creation of custom-planned vacations for sophisticated travelers seeking individual attention and superior customer service. We put a great deal of time and effort into every vacation that we create for our clients. We research hotels, cruises and tours to meet your specific needs, contact suppliers and industry connections, coordinate transportation, and draft itineraries. Your personalized itinerary and detailed travel documents will give you as smooth and seamless a vacation as possible. We have a rate structure to assist with the time spent covering the initial consultation, research and proposal. We will advise you of our fee for your journey. Our consulting fee will be charged upon proposal delivery, regardless of whether a client books a trip with us. When a client books a trip with us, this fee also goes toward travel support and the booking of the trip itself. The consulting fees are nonrefundable. We may also collect a commission from the supplier of your trip.
ELECTRONIC OR HANDWRITTEN SIGNATURE: Both parties agree that you may acknowledge and agree to these Terms: (i) electronically; (ii) by handwritten signature; (iii) by any other electronic means, including without limitation acknowledgement via email acceptance of these Terms; or (iv) by your implied consent deemed via your actions which shall include without limitation the payment of the invoice and/ or your use of the services provided by Zotto Travel LLC or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgement and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.
GOVERNING LAW: The construction, validity and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the State of New Jersey, without giving effect to its conflicts of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the State of New Jersey with respect to any legal proceedings relating to these Terms.
